If we provide desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided you agree to be bound by our end user license agreement for such applications.

Provided that you are eligible to use the Website, SkyWest grants you a limited license to access and use the Website and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use.  We reserve all rights not expressly granted to you in and to the Website, the Content and the Marks.

4. MONITORING AND ENFORCEMENT; DISCLAIMER OF LIABILITY

We have the right to:

• Remove or refuse to post any User Contributions for any or no reason in our sole discretion.
• Take any action with respect to any User Contribution that we deem necessary or appropriate in our sole discretion, including if we believe that such User Contribution violates the Terms of Use, including the Content Standards, infringes any intellectual property right or other right of any person or entity, threatens the personal safety of users of the Website or the public, or could create liability for SkyWest.
• Disclose your identity or other information about you to any third party who claims that material posted by you violates their rights, including their intellectual property rights or their right to privacy.

SkyWest is against copyright infringement of any kind, and we terminate the user accounts of repeat copyright infringers. If you believe that any material on the Website infringes your copyright, please send a notice of copyright infringement to CUSTOMERSERVICE@SKYWEST.COM.  Upon receipt of any notice, SkyWest will take whatever action, in its sole discretion, including removing the content from the Website.

All information we collect on this Website is subject to our Privacy Policy. By using the Website, you consent to all actions taken by us with respect to your information and agree to be bound by our Privacy Policy, which is incorporated into these Terms of Use.  The Website is hosted in the United States and we make no claim that the Website or any of its content is accessible or appropriate outside of the United States.  If you access the Website from outside the United States with laws or regulations governing personal data collection, use or disclosure that differ from applicable laws in the United States, you are transferring your data to the United States and you agree to have your data transferred to and processed in the United States.

9. LIMITATION OF LIABILITY

IN NO EVENT WILL SKYWEST, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE WEBSITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE WEBSITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

11. GOVERNING LAW AND JURISDICTION

All matters relating to the Website and these Terms of Use, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Utah without regard to its conflict of law provisions (whether of the State of Utah or any other jurisdiction).

Any legal suit, action, or proceeding arising out of, or related to, these Terms of Use or the Website shall be instituted exclusively in the federal courts of the United States or the courts of the State of Utah, in each case located in Salt Lake County, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms of Use in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.  Application of the United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transaction Act (UCITA) are excluded from these Terms of Use.

12. ARBITRATION

At Company's sole discretion, it may require you to submit any disputes arising from these Terms of Use or use of the Website, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association applying Utah law. 

In no event shall any dispute brought by either party related in any way to the Website be commenced more than one (1) year after the cause of action arose. 

13. ELECTRONIC COMMUNICATIONS, TRANSACTIONS AND SIGNATURES

Sending us emails, visiting the Website, and completing online forms constitute electronic communications.  You consent to receive electronic communications and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email or on the Website, satisfy any legal requirement that such communication be in writing.

14. SMS COMMUNICATION

By opting into SMS messaging, you agree to receive periodic automated marketing and informational text messages from SkyWest Airlines for SkyWest. Automated messages may be sent using an automatic telephone dialing system to the mobile telephone number you provided when signing up or any other number that you designate. You are not required to agree to enter into any agreement as a condition to purchase any services from SkyWest and you can cancel at any time. Message frequency varies, and additional mobile messages may be sent periodically based on your interaction with us. We reserve the right to alter the frequency of messages sent at any time to increase or decrease the total number of sent messages. We also reserve the right to change the short code or phone number where messages are sent. Message and data rates may apply.

If you have any questions about your text plan or data plan, it is best to contact your wireless provider. Your wireless provider is not liable for delayed or undelivered messages.

You agree that before changing your mobile number or transferring your mobile number to another individual, you will either reply “STOP” from the original number or notify us of your old number at privacy@skywest.com. The duty to inform us based on the above events is a condition of using this service to receive messages.

You can cancel SMS messages at any time by texting "STOP." After you send the SMS message "STOP," we will send you a message to confirm that you have been unsubscribed and no more messages will be sent. If you would like to receive messages from SkyWest Airlines again, just sign up as you did the first time and we will start sending messages to you again. 15. MISCELLANEOUS

These Terms of Use and our Privacy Policy, including any policies or operating rules posted by us on the Website constitute the entire agreement and understanding between you and us.  No waiver by us of any term or condition set out in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and our failure to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.  If any provision of this Agreement is found to be invalid or unenforceable, then the remainder of this Agreement will have full force and effect and the invalid provision will be modified, or partially enforced, to the maximum extent permitted to effectuate the original objective.  We may assign any or all of our rights and obligations to others at any time.  The section headings contained in this Agreement are for reference purposes only and will not affect in any way the meaning or interpretation of this Terms of Use.  You agree that these Terms of Use will not be construed against us by virtue of having drafted them.  You hereby waive any and all defenses you may have based on the electronic form of these Terms of Use and the lack of signing by the parties hereto to execute these Terms of Use.
